Terms and Conditions

1. Introduction

Snow Enclosure Trekking Pvt. Ltd. is dedicated to providing unforgettable trekking and adventure experiences in the majestic landscapes of [Region/Area, e.g., the Himalayas]. 2. Booking and Payment

• A non-refundable deposit of 15% of the total trip cost is required to confirm a booking.
• An additional payment of 30% of the total trip cost must be made at least 30 days before the trip departure date.
• The remaining balance must be paid upon arrival before the trip commences.
• Payments can be made via bank transfer, credit card, or other accepted methods.

3. Late Booking

• For bookings made within [X] days of the trip departure date, full payment is required at the time of booking.
• Availability for late bookings is subject to accommodation and permit availability, and additional fees may apply.
• Snow Enclosure Trekking Pvt. Ltd. cannot guarantee availability for late bookings and reserves the right to refuse such bookings based on logistical constraints.

 

4. Cancellation Policy

• If a cancellation is made more than [X] days before the trip, the non-refundable deposit of [X]% will be retained, and any additional payments made will be refunded, minus a [Y]% cancellation fee.
• If a cancellation is made between [X] and 15 days before the trip departure date, [Z]% of the total trip cost will be retained, with the balance refunded.
• No refund will be provided for cancellations made within 15 days of the trip departure date.
• Snow Enclosure Trekking Pvt. Ltd. reserves the right to cancel a trip due to unforeseen circumstances, in which case a full refund of all payments made, including the non-refundable deposit, will be provided.

 

5. Itinerary Changes

• Snow Enclosure Trekking Pvt. Ltd. reserves the right to modify the itinerary in case of adverse weather conditions, roadblocks, strikes, or other unforeseen events that may impact the safety or feasibility of the planned trip.
• Clients must inform Snow Enclosure Trekking Pvt. Ltd. of any desired changes to the itinerary at least one week before the scheduled departure date.
• Any changes to the itinerary requested by the client, including modifications to accommodation, transportation, permits, or airfare, may incur additional costs. These additional costs will be the responsibility of the client and must be paid directly to Snow Enclosure Trekking Pvt. Ltd. or the relevant service providers.
• If changes result in increased costs for accommodation, transportation, permits, or airfare, the client will be notified of these additional charges. The client is required to cover these costs promptly to ensure the continuation of the modified itinerary.
• Snow Enclosure Trekking Pvt. Ltd. will provide detailed information about any significant changes to the itinerary and associated costs, including any changes to airfare, as soon as possible. The client will be given a clear breakdown of any additional charges and must approve them before finalizing the modified itinerary.

 

6. Health and Fitness

• Clients are responsible for ensuring they are in good health and physically fit for the activities included in the trip.
• A medical certificate may be required before participation in certain treks or activities.
• Comprehensive travel and health insurance that covers high-altitude trekking, emergency evacuation and medical expenses is mandatory.

 

7. Travel Insurance 

• It is a strict requirement that all clients obtain comprehensive travel insurance before participating in any trip organized by Snow Enclosure Trekking Pvt. Ltd.
• The insurance must cover all aspects of the trip, including but not limited to: trip cancellations, medical expenses, emergency evacuations, personal liability, loss or damage of personal belongings, delays, and any other unforeseen circumstances that may arise during the trip.
• Proof of insurance must be provided before the trip commences. Failure to present valid insurance may result in the cancellation of the booking without refund.

 

8. Risk and Liability

• Trekking and adventure activities involve inherent risks. By participating, these risks are acknowledged, and Snow Enclosure Trekking Pvt. Ltd. shall not be liable for any loss, injury, or damage to persons or property.
• Clients are strongly encouraged to ensure their travel insurance comprehensively covers all potential risks or emergencies that may occur during the trip.

 

9. Passport and Visas

• It is the client’s responsibility to ensure possession of a valid passport and necessary visas for entry into the destination country.
• Snow Enclosure Trekking Pvt. Ltd. is not responsible for any delays or costs incurred due to insufficient travel documentation.

 

19. Discounts and Special Rates

• Groups: Special discounts are available for group bookings. Groups of [X] or more participants can benefit from reduced rates. • Students and Educational Institutions: Discounts are offered to students and educational institutions. These reductions are available to support educational endeavors. • Individuals Traveling for Volunteer Work: Special rates are available for individuals traveling to Nepal for volunteer work. Discounts are provided to support those contributing to community and development projects. Evidence of volunteer work or affiliation with a volunteer organization may be required. • Business-to-Business (B2B) Rates: Customized rates are available for businesses seeking to collaborate with Snow Enclosure Trekking Pvt. Ltd. for corporate travel. These rates offer tailored solutions and discounts for business clients. 10. Complaints and Disputes

• Any complaints during the trip should be reported immediately to the guide or Snow Enclosure Trekking Pvt. Ltd. to address the issue promptly.
• In the event of a dispute, clients are encouraged to resolve the issue directly with Snow Enclosure Trekking Pvt. Ltd. through amicable negotiation and discussion.
• All services provided by Snow Enclosure Trekking Pvt. Ltd. are in compliance with local government laws and regulations. In case of any legal dispute, Snow Enclosure Trekking Pvt. Ltd. adheres to the laws of Nepal.
• Any legal action or proceeding related to these terms and conditions or the services provided shall be brought exclusively in the courts of Nepal.
• Clients must agree to comply with all local laws and regulations while participating in trips organized by Snow Enclosure Trekking Pvt. Ltd.

 

11. Return of Used Products

• Clients are responsible for the return of any products or equipment provided by Snow Enclosure Trekking Pvt. Ltd. that were used during the trip, such as trekking gear, safety equipment, or other rented items.
• All rented or provided products must be returned in good condition, with normal wear and tear expected. Clients must return these items to Snow Enclosure Trekking Pvt. Ltd. at the end of the trip or as specified by the company.
• In the event that any products are lost, damaged beyond normal wear and tear, or not returned, clients will be liable for the cost of repair or replacement. The cost will be determined based on the extent of damage or loss and will be charged accordingly.
• Snow Enclosure Trekking Pvt. Ltd. reserves the right to deduct the cost of repairs or replacements from any refundable amounts or to seek additional payment from the client if necessary.
• Clients will be notified of any charges related to the return of used products, and payment for such charges will be required promptly.

12. Privacy Policy

• Personal information provided to Snow Enclosure Trekking Pvt. Ltd. is respected and protected in accordance with the company’s Privacy Policy. Details on how personal data is collected, used, and protected can be found in the Privacy Policy.

 

13. Governing Law

• These terms and conditions are governed by and construed in accordance with the laws of Nepal.
• Any legal action or proceeding related to these terms and conditions shall be brought exclusively in the courts of Nepal.

 

15. Compensation to Clients

• Service Disruptions: In the rare event that Snow Enclosure Trekking Pvt. Ltd. is unable to provide agreed-upon services, such as significant itinerary changes or essential services not delivered, clients may be entitled to compensation.
• Compensation Amount: Compensation provided to clients will be based on the extent of the disruption or failure to deliver promised services. However, the total compensation amount will not exceed the total cost of the trip.
• Unused Services: Compensation will not be provided for any services or activities that were available but not utilized by the client. This includes, but is not limited to, accommodation, transportation, or excursions that were included in the trip package but not used by the client.
• Shortened Trips: If the booked trip is completed early due to external factors beyond the company’s control, such as adverse weather conditions or other unforeseen events, no refund or compensation will be provided for the shortened duration or early termination.
• Refunds: If Snow Enclosure Trekking Pvt. Ltd. is unable to deliver key elements of the trip, clients may receive a refund based on the value of the undelivered services. The maximum refund or compensation amount will be limited to the total cost of the trip.
• Resolution: Snow Enclosure Trekking Pvt. Ltd. is committed to addressing any issues promptly and fairly. In the event of service disruptions, the company will evaluate the situation and provide appropriate compensation, which may include a refund or other remedies, as deemed suitable. The aim is to resolve any concerns in a manner that reflects the impact of the disruption on the client’s experience.
• Limitations: Compensation will be limited to the value of the services affected and will not cover any indirect or consequential losses, such as personal inconvenience, travel delays, or additional expenses incurred by the client.

16. Publicity of Photos and Videos

 

• Permission to Use Media: By participating in trips organized by Snow Enclosure Trekking Pvt. Ltd., clients grant permission for any photographs, videos, or other media taken during the trip to be used for promotional purposes.

 

• Use of Media: Snow Enclosure Trekking Pvt. Ltd. may use photos and videos of clients on its website, social media pages, and other marketing materials to promote the company’s services. This includes, but is not limited to, marketing campaigns, brochures, and advertisements.

 

• Client Rights: Clients have the right to request that their images or videos not be used for promotional purposes. Such requests should be made in writing to Snow Enclosure Trekking Pvt. Ltd. prior to or during the trip.

 

• No Compensation: No compensation will be provided to clients for the use of their images or videos in promotional materials.

 

• Privacy: Snow Enclosure Trekking Pvt. Ltd. will ensure that the use of any media respects the privacy of the clients and will avoid using images or videos in a manner that could be considered inappropriate or misleading.

 

18. Personal Belongings

• Handling of Personal Items: Snow Enclosure Trekking Pvt. Ltd. staff may assist in handling clients’ personal belongings during the trip. However, the company will not be responsible for any damage, loss, or theft of personal items while they are being handled by staff or during the trip.

 

• No Compensation: Clients acknowledge that Snow Enclosure Trekking Pvt. Ltd. is not liable for any damage to or loss of personal items. No compensation will be provided for such incidents.

 

• Client Responsibility: Clients are advised to take necessary precautions to safeguard their personal belongings and to ensure that valuable items are insured separately. It is recommended that clients carry appropriate insurance coverage for their personal items during the trip.

 

17. Acceptance of Terms

• Agreement: By making a reservation with Snow Enclosure Trekking Pvt. Ltd., clients confirm their acceptance of these terms and conditions, establishing a binding contract between both parties.
• Confirmation: Clients will receive a confirmation email or document summarizing the terms. It is important for clients to review these terms carefully and address any questions before finalizing their booking.
• Modifications: Snow Enclosure Trekking Pvt. Ltd. may update these terms as needed. Clients will be informed of significant changes, and continued participation in the trip will signify acceptance of the updated terms.
• Compliance: Clients are responsible for adhering to all terms and relevant laws. Any issues related to the terms should be resolved with Snow Enclosure Trekking Pvt. Ltd. at check-in or before the trip commences.

Waiver: Upon arrival, clients are required to sign a waiver acknowledging their understanding of an agreement to the terms and conditions. This waiver serves as a formal acceptance of the policies and releases the company from certain liabilities.
